When To Get A Work Comp Lawyer
A lot of people who contact us with questions about Illinois workers compensation law want to know when they should get an attorney for their claim. While every case is different, for most people it makes sense to at least have a consultation if you have more than a minor injury. The more serious the injury, the more necessary it is to get legal help to protect you from the insurance company.
For example, if a person gets hurt on the job and has a scrape or contusion and the doctor says no further medical care is necessary, they don’t need a lawyer. There is not much a lawyer can do to help that person other than advise them how to get the bill for their doctor visit paid for. We will give you that advice for free.
On the other hand, if you tore your ACL or have a herniated disc or some other big problem, you’d be best served by having an experienced law firm in your corner. The more medical treatment someone needs, the more likely a person will benefit from legal help.
Even if it appears that your employer and the insurance company are treating you fairly and doing the right things, it is still important to retain a workers comp lawyer for your serious injury. The insurance company is motivated to find any reason to deny, delay or stop your work comp benefits. They are not in business to make your life easy. They make money by limiting what they pay out on a case.
In fact, the longer your case goes on, the more likely it is that the insurance company will attempt to derail it. Some ways they do this include appointing a nurse case manager who shows up to your appointments and tries to talk to your doctor which is illegal. They will also seek out medical records that aren’t relevant to your case by getting you to sign an overly broad medical authorization form (you don’t have to sign). Many times they will send you to a hired gun IME doctor to give an opinion on your case. Or they will conduct surveillance on you any possibly try to imply you are faking your injury by taking a snippet of video out of context.
